Abstract
La théorie de la responsabilité civile judiciaire est au cœur du nouveau paradigme de la justice au Québec. Elle rassemble sous un même concept l’abus de procédure, l’abus d’ester en justice, la proportionnalité, la coopération et les autres principes directeurs de la procédure. Elle a comme fonction de normer et conditionner l’accès à la justice afin de favoriser les causes ayant une question d’intérêt de fait ou de droit ou une question mixte à faire trancher. Ce faisant, la pression sur le système judiciaire sera diminuée par l’usage plus fréquent des modes privés de prévention et de règlement des différends et la recherche de solutions aux différends autrement que par la judiciarisation. Avec le temps, l’excès sera expurgé ou les fautifs seront condamnés à payer des dommages-intérêts à la partie victime du non-respect des nouvelles normes d’accessibilité à la justice. Cette conséquence générera par le fait même une justice plus proche de la vérité.
