Abstract
Abstract The chapter distils the development and the outcomes of the jurisprudence of the Supreme Court of Canada on dignity. Despite the paucity of legal and constitutional references to the notion of dignity, through its frequently activist approach, the Supreme Court has used it in a vast array of cases, spanning from new rights or the protection of indigenous minorities to the police powers to conduct searches, freedom of speech, and death penalty extraditions. Since embracing an activist approach with the enactment of the Canadian Charter of Rights and Freedoms in 1982, the court has tried to make sense of an extremely diverse society and its multicultural agenda. Its rulings have drawn from a variety of sources, combining common law and civil law, Christian and secular thinking, and anglophone and continental European heritage. Although several justices initially resisted it, the court ultimately embraced a secular and individualistic approach to dignity.
