Cet article propose une analyse critique approfondie de la phase d’instruction dans le système judiciaire marocain, en mettant en lumière les déséquilibres structurels et fonctionnels qui affectent les interactions entre le juge d’instruction et les autres acteurs de la procédure pénale. Il s’appuie sur une étude rigoureuse du cadre normatif actuel (Code de procédure pénale, textes organiques, jurisprudence) et sur l’observation des pratiques judiciaires pour démontrer l’écart persistant entre les principes affichés (contradictoire, impartialité, égalité des armes) et leur effectivité. L’article examine dans une première partie le rôle du juge d’instruction, son statut hybride, ainsi que les rapports parfois déséquilibrés qu’il entretient avec le ministère public, la défense, les parties civiles et les auxiliaires de justice. Il met en évidence les pressions institutionnelles, les lacunes procédurales, et l'absence de recours effectif en cours d’instruction. Dans une seconde partie, l’étude propose une série de pistes de réforme, fondées à la fois sur les besoins internes (renforcement du contradictoire, collégialité, contrôle procédural, numérisation) et sur des comparaisons internationales éclairantes (France, Belgique, Espagne, Canada). Elle s’achève sur un appel à repenser l’architecture procédurale de l’instruction au Maroc dans une logique de modernisation, de transparence et de respect effectif des droits fondamentaux.
