Het aantal ongehuwde samenwoners neemt steeds verder toe, momenteel zijn er 2,2 miljoen samenwoners. Een ongelijke taakverdeling is eerder regel dan uitzondering bij samenwoners met kinderen en heeft een genderdimensie omdat het voornamelijk vrouwen zijn die het merendeel van de zorg voor kinderen op zich nemen. Het recht biedt echter vrijwel geen compensatie aan de verzorgende partner bij scheiding, vanwege de nadruk op de eigen verantwoordelijkheid van samenwoners. Compensatie is wenselijk en dat vereist dat het recht zorg waardeert.
