Abstract
La regulación de los supuestos en los que existen «diversos fiadores de un mismo deudor y por una misma deuda» presenta diferencias significativas en Derecho comparado. En este trabajo se pretende contrastar el modelo adoptado por el Code civil francés –seguido, a su vez, por la codificación quebequesa– con el elegido por el legislador español, en el bien entendido que nos centrare mos exclusivamente en los efectos de la pluralidad de fiadores frente al acreedor y en el llamado «beneficio de división»; no pretendemos analizar, en cambio, los efectos que se producen entre los diversos fiadores.
