Abstract
Bij de gezamenlijke gezagsuitoefening kunnen geschillen ontstaan over een eventuele verhuizing na scheiding, waarvoor vervangende toestemming kan worden verzocht bij de rechter (artikel 1:253a BW). Rechters kunnen dergelijke verzoeken beoordelen aan de hand van verhuiscriteria, die in principe zijn ontwikkeld voor verhuizingen van de ouder waar het kind het hoofdverblijf heeft. In de rechtswetenschappelijke literatuur is opgemerkt dat het beoordelingskader minder duidelijk is voor verhuizingen waarin een verzoek tot vervangende toestemming wordt ingediend door de ouder bij wie het kind niet de hoofdverblijfplaats heeft. Daarom wordt in deze bijdrage, aan de hand van een systematische jurisprudentieanalyse tussen januari 2018 en oktober 2024, onderzocht hoe hiermee in de rechtspraktijk wordt omgegaan.
