Abstract
La séparation des pouvoirs est un principe central du droit constitutionnel. Son rôle est déterminant dans la construction du régime de responsabilité des pouvoirs publics. En Belgique, la Cour de cassation a élaboré un régime complet de responsabilité de l’État du fait des pouvoirs exécutif, judiciaire et législatif. Tel n’est pas le cas dans tous les États, notamment au Canada, où la responsabilité des pouvoirs judiciaire et législatif paraît inenvisageable. Cet article s’intéresse en particulier au pouvoir législatif. Il examine l'influence de la conception de la séparation des pouvoirs sur le développement de la responsabilité du pouvoir législatif en Belgique et au Canada. Il montre que les deux systèmes juridiques ne partagent pas la même approche de la séparation des pouvoirs. Alors que les pouvoirs sont égaux en Belgique, tel n’est pas le cas au Canada. La séparation des fonctions semble également plus marquée outre-Atlantique. Enfin, l'influence des droits fondamentaux et du droit européen a joué un rôle dans le développement de la responsabilité du législateur belge.
