Abstract
De 'chain rule' heeft sinds een comité van deskundigen die in 2007 opstelde, veel onduidelijkheden en vertragingen veroorzaakt in terugname- en overdrachtsprocedures, voor de situatie dat een vreemdeling in meerdere lidstaten asielverzoeken heeft ingediend. Welke Dublinstaat was nu voor het asielverzoek verantwoordelijk? Het HvJ EU heeft aan die onduidelijkheden op 12 januari 2023 een eind gemaakt: er is geen juridische basis voor die 'chain rule'. En na 18 maanden is de eerste lidstaat niet meer verantwoordelijk voor het asielverzoek. Anne Spijkstra bespreekt de overwegingen van het Hof en licht de uitgangspunten toe die de lidstaten nu in acht moeten nemen bij toepassing van de Dublin III-verordening.
