Abstract
Putusan Mahkamah Konstitusi Nomor 135/PUU-XXII/2024 menetapkan bahwa pemilu nasional (pilpres, DPR, dan DPD) dan pemilu lokal (pilkada dan DPRD) tidak lagi dilaksanakan secara serentak, melainkan dipisah dengan jeda 2–2,5 tahun. Putusan ini dianggap sebagai koreksi terhadap beban sistemik pemilu serentak yang diterapkan pada 2019, namun juga menimbulkan perdebatan mengenai wewenang MK dan potensi pelanggaran terhadap ketentuan lima tahunan dalam UUD 1945. Penelitian ini menggunakan pendekatan yuridis normatif untuk mengkaji implikasi konstitusional, posisi hukum MK sebagai Negative Legislator, serta tantangan implementasi dalam kerangka hukum positif. Hasil kajian menunjukkan bahwa putusan ini memerlukan revisi undang-undang secara komprehensif agar tidak terjadi kekosongan hukum atau krisis legitimasi demokrasi. Selain itu, peran lembaga legislatif dan penyelenggara pemilu menjadi krusial dalam menjembatani ketentuan konstitusi dengan kebutuhan sistem kepemiluan yang lebih efektif dan efisien.
