Abstract
La problemàtica de l'habitatge ha estat contínuament en el focus d'atenció de l'agenda social i política. Les conseqüències que té generen una situació d'emergència habitacional mai vista que ha obligat els legisladors autonòmics a dictar una normativa enfocada primordialment al bastiment de mecanismes jurídics per actuar contra l'exclusió residencial i garantir l'assequibilitat de l'habitatge (expropiació temporal de l'ús de l'habitatge, lloguer social obligatori, limitació de rendes de lloguer, etc.). A Catalunya, aquesta nova mirada sobre l'habitatge la representen les lleis 24/2015 i 4/2016, que posen títol a una tercera generació de normes sobre habitatge. L'accés a l'habitatge constitueix una preocupació social de primer ordre. La hipertròfia normativa existent a Catalunya en matèria d'habitatge, amb normes que contenen reiterades esmenes, modificacions i remissions, fa imprescindible que el Govern de la Generalitat abordi de forma peremptòria una refosa que compili en un únic text legal les disposicions legals vigents en matèria del dret a l'habitatge.
