บทคัดย่อ บทความนี้มุ่งวิเคราะห์วิวัฒนาการของหลักการที่ศาลควรให้ความเคารพต่อดุลพินิจของฝ่ายปกครอง(Deference) ในกฎหมายปกครองของประเทศแคนาดาและเปรียบเทียบกับระบบกฎหมายปกครองไทยโดยอาศัยงานวิจัยของ Paul Daly และเอกสารวิชาการที่เกี่ยวข้อง การศึกษาครั้งนี้แบ่งการพัฒนาหลักการDeference ในประเทศแคนาดาออกเป็น 4 ช่วงเวลาสำคัญ ได้แก่ ช่วง 1949-1979 ยุคก่อนหลัก Deferenceสมัยแห่งการแทรกแซงของศาล ช่วง 1979-1988 ยุคการเกิดขึ้นของหลักการที่ศาลควรให้ความเคารพต่อดุลพินิจของฝ่ายปกครองและการปฏิวัติในคดี Canadian Union of Public Employees v New Brunswick Liquor Corporation (CUPE) ช่วง 1988-2008 ยุคที่ศาลกลับมาแทรกแซงครอบงำในประเด็นขอบเขตอำนาจและข้อกฎหมาย ช่วงปฏิรูปยุคหลังปี 2008 ในกฎหมายปกครองแคนาดาถูกเรียกว่า “ยุคแห่งการต่อสู้เพื่อความสมเหตุสมผล” และ ช่วง 2019 ยุคการปฏิรูปครั้งใหม่ การศึกษาพบว่าหลักการ Deference ในประเทศแคนาดาเป็นการต่อสู้ที่ไม่มีวันจบสิ้นระหว่างแนวคิดการเคารพดุลพินิจของฝ่ายปกครองกับแนวโน้มการแทรกแซงของศาล ซึ่งเริ่มต้นจากความตึงเครียดในการแทรกแซงงานของคณะกรรมการแรงงานโดยศาล และได้รับการตอบสนองจากนักวิชาการที่วิพากษ์วิจารณ์การ แทรกแซงที่เกินขอบเขต การเปลี่ยนแปลงครั้งสำคัญเกิดขึ้นจากคำพิพากษาคดี Canadian Union of Public Employees v New Brunswick Liquor Corporation (CUPE) ปี 1979 ซึ่งถือเป็นจุดเปลี่ยนที่สำคัญในประวัติศาสตร์กฎหมายปกครองแคนาดา โดยผู้พิพากษา Dickson J. ที่วางรากฐาน มาตรฐานความสมเหตุสมผลและพัฒนาสู่การวิเคราะห์เชิงปฏิบัติและการทำงาน ในคดี Bibeault (1988) หลังจากนั้นประสบปัญหาความสับสนจากมาตรฐานการตรวจสอบหลายระดับ จนได้รับการปฏิรูปในคดี Dunsmuir (2008) และ Vavilov (2019) เพื่อลดความซับซ้อนในการพิจารณาคดีในเวลาต่อมา ส่วนระบบกฎหมายไทยศาลปกครองได้พัฒนาแนวคิดที่เน้นความชอบด้วยกฎหมาย (legality review) และหลักนิติรัฐเป็นสำคัญ แม้จะไม่มีหลักคำสอนหลักการที่ศาลควรให้ความเคารพต่อดุลพินิจของฝ่ายปกครอง (Deference) ที่ชัดเจน แต่งานวิจัยไทยแสดงให้เห็นถึงความท้าทายที่คล้ายคลึงกันในเชิงหน้าที่ (functional challenges) โดยเฉพาะการที่ศาลต้องพิจารณาประเด็นที่ต้องอาศัยความเชี่ยวชาญเฉพาะทาง แม้ทั้งสองระบบจะมีความแตกต่างกันในโครงสร้างและปรัชญา แต่ต่างก็เผชิญกับความท้าทายเดียวกันในการสร้างสมดุลระหว่างอำนาจศาลกับความเป็นอิสระและความเชี่ยวชาญของฝ่ายปกครอง เพื่อเป็นแนวทางเชิงนโยบายในการพัฒนากฎหมายปกครองไทยโดยเฉพาะในการสร้างกลไกเชิงสถาบันที่สนับสนุนการตัดสินใจของศาลด้วยความเชี่ยวชาญเฉพาะด้าน คำสำคัญ: หลักการที่ศาลควรให้ความเคารพต่อดุลพินิจของฝ่ายปกครอง (Deference), กฎหมายปกครอง, การตรวจสอบเชิงตุลาการ, การเปรียบเทียบกฎหมาย, แคนาดา, ไทย Abstract This article analyzes the evolution of the principle of Deference in Canadianadministrative law and compares it with the Thai administrative law system, drawing on theresearch of Paul Daly and related academic works. The study divides the development of the Deference principle in Canada into fourmajor periods: 1949–1979, the pre-Deference era marked by judicial intervention; 1979–1988, the rise of the Deference principle and the revolution in the CUPE case; 1988–2008, a period of renewed judicial dominance over jurisdictional and legal questions; the post-2008 reform era, known in Canadian administrative law as "the struggle for reasonableness"; and the 2019 era of new reform. The study finds that the Deference principle in Canada is an “unending struggle”between the idea of respecting administrative discretion and the tendency toward judicialintervention. This struggle originated from the tension created by court interventions in thework of labour relations boards and was met with a critical response from scholars whocriticized the excessive judicial interference. A major change arose from the 1979 Supreme Court judgment in the Canadian Unionof Public Employees v New Brunswick Liquor Corporation (CUPE), a significant turning point inthe history of Canadian administrative law, where Justice Dickson laid the foundation for thereasonableness standard that later evolved into a pragmatic and functional analysis in theBibeault case (1988). Following this, the system faced the problem of confusion from multiplestandards of review, which led to subsequent reforms in the Dunsmuir case (2008) and Vavilovcase (2019) to simplify the review process. In the Thai legal system, the Administrative Court has developed a concept that primarily emphasizes the legality review and the Rule of Law. Although a clear doctrine of Deference is absent, Thai research indicates similar functional challenges, particularly when the court must consider issues requiring specialized expertise. Despite structural and philosophical differences, both systems face the common challenge of balancing judicial authority with the independence and expertise of the administration. This study offers policy guidance for developing Thai administrative law, particularly in creating institutional mechanisms that support judicial decision-making with specialized expertise.
