Abstract

Bu bölüm, Kamu Denetçiliği Kurumu (KDK) kararları aracılığıyla büyükşehir belediyelerinin sunduğu yerel hizmetlerin niteliğini ve bu hizmetler bağlamında ortaya çıkan idari uyuşmazlık alanlarını incelemeyi amaçlamaktadır. Araştırma, KDK’nin çevrimiçi ortamda kamuya açık olan Kararlar Bilgi Bankası verilerinin nitel analizi üzerine temellendirilmiştir. Çalışma kapsamında 2013–2025 yılları arasında yayımlanan toplam 13.484 karar içerisinden, “Mahalli İdarelerce Yürütülen Hizmetler” başlığı altında yer alan 185 karar inceleme kapsamına alınmıştır. Veriler doküman analizi yöntemiyle çözümlenmiş; elde edilen bulgular içerik analizi ve tematik analiz teknikleriyle sınıflandırılmıştır. Analiz sonuçları büyükşehir belediyeleri hakkında yapılan şikâyetlerin en çok ulaşım, su ve kanalizasyon, imar ve mülkiyet, çevre yönetimi, ticari ruhsatlandırma ve sosyal hizmetler alanlarında yoğunlaştığını ortaya koymuştur. Bulgular, belediyelerin hizmet sunum süreçlerinde mevzuat uygulamaları ile vatandaş beklentileri arasında belirgin bir uyumsuzluk bulunduğunu göstermektedir. Ayrıca, ombudsmanlık kararlarının bağlayıcı bir niteliğe sahip olmamasına karşın bu kararların idarenin şeffaflık, hesap verebilirlik, katılımcılık ve insan hakları temelli kamu hizmeti anlayışının güçlendirilmesine önemli katkılar sunduğu sonucuna ulaşılmıştır.
