La funcionalidad del neoconstitucionalismo al neoliberalismo en Brasil

Abstract
A pesquisa parte do pressuposto de que o neoconstitucionalismo se tornou hegemônico enquanto teoria e prática no ambiente jurídico brasileiro. Desde os anos 1990, suas técnicas operam a transformação do direito brasileiro com a introdução do pós-positivismo, defesa da prevalência do Poder Judiciário e o direito jurisprudencial como modelo, além da centralização da Constituição Federal como norma aplicável e interpretativa de todo o direito. Buscou-se analisar criticamente tal fenômeno jurídico a partir de Foucault, Laval, Dardot e Garapon. Tais autores têm como objeto de análise social do neoliberalismo enquanto sistema normativo. Na relação estabelecida entre os dois objetos, se concluiu que o neoconstitucionalismo é funcional ao neoliberalismo no Brasil tendo em vista que introduziu na produção e aplicação do direito o modelo concorrencial e a diminuição da soberania popular, tendo como resultado a judicialização da vida e da política e o incrimento do controle sobre o Poder Executivo e Legislativo pelo Sistema de Justiça.
