Abstract
O princípio da separação de poderes é o que limita ações e desconcentra, das mãos de apenas um sujeito, os rumos de uma sociedade. Os ditames do Estado Democrático de Direito sobrevivem com base na submissão dos governantes ao império do Direito, recebendo feedback de seu trabalho através das eleições livres e realizadas periodicamente. A presente pesquisa visa analisar o fenômeno do ativismo político estatal, exercido por determinados sujeitos que, por meio de suas respectivas instituições, interferem ativa ou passivamente, participando do jogo político, ainda que não eleitos para tanto. Por outro lado, esses mesmos sujeitos, a depender do tema, podem agir ativamente, por interesses próprios, ou se omitir de forma intencional. Este estudo abordará, em um primeiro momento, o instituto da confiança e seus efeitos na consolidação do regime democrático. Através do confronto crítico do já publicado pela melhor doutrina especializada, junto a dados obtidos dos mais diversos órgãos e poderes, o estudo traçará a existência de eventuais reflexos, seja por ação ou omissão, em legislações – ou na Constituição – que beneficiaram determinadas categorias ou modificaram o jogo político nas últimas duas décadas, em detrimento da atuação do Poder Legislativo.
