Une réinsertion en trompe-l’œil : les conditions judiciaires de la surveillance communautaire à la loupe

Abstract
Au Québec, les mesures de surveillance communautaire visent principalement la réinsertion sociale, mais les manquements aux conditions sont en forte hausse, contribuant à la surcharge du système judiciaire et carcéral. Si la littérature a commencé à interroger le rôle des conditions dans ces manquements, cet article vise à comprendre comment celles-ci peuvent, dans leur mise en œuvre concrète, constituer un obstacle à la réinsertion. Appuyée sur une enquête qualitative menée auprès de 20 intervenants communautaires, l’analyse identifie trois niveaux d’obstacles liés aux trajectoires individuelles, aux pratiques professionnelles et aux cadres structurels et met ainsi en lumière une distribution inégale des responsabilités entre personnes judiciarisées, professionnels et institutions.
