Kegiatan pertambangan rakyat umumnya merupakan kegiatan informal yang tidak memiliki izin namun menjadi sarana yang menyediakan kesempatan kerja dan sumber pendapatan bagi masyarakat yang sudah berjalan turun temurun dan tersebar di seluruh Indonesia. Kegiatan pertambangan rakyat bukan hanya menghasilkan dampak negatif namun juga dampak positif bagi pembangunan berkelanjutan di wilayahnya ketika dapat dikelola secara baik dan benar. Pada kenyataanya, ketidakselarasan kebijakan saat ini mengakibatkan tidak terkendalinya kegiatan pertambangan rakyat dan pada beberapa lokasi terjadi konflik antara masyarakat penambang dan pemerintah akibat penutupan oleh aparat terkait yang pada akhirnya menjadi tidak efektif karena masyarakat tetap melakukan kegiatannnya secara sembunyi-sembunyi. Penelitian ini dilakukan untuk membahas secara lebih mendalam tentang bagaimana ketidakselarasan kebijakan saat ini melalui Wilayah Pertambangan Rakyat (WPR) setelah ditetapkannya UU Nomor 3 Thn. 2020 yang belum dibahas secara sepesifik dari beberapa penelitian sebelumnya terkait formalisasi kegiatan pertambangan rakyat. Dengan melakukan pendekatan kualitatif melalui studi literatur dan komparasi atas kebijakan yang telah diterbitkan oleh Pemerintah serta penelitian penelitian sebelumnya ditemukan adanya upaya pemerintah untuk melakukan akselerasi atas formalisasi kegiatan pertambangan rakyat yang terhambat atas adanya ketidakselarasan kebijakan antar sektor yang harus segera ditindaklanjuti.
