O presente artigo tem por objetivo, com base no exemplo canadense, demonstrar, a partir da teoria dos sistemas sociais autopoiéticos aplicadas ao Direito (Luhmann), a insuficiente diferenciação funcional do direito à saúde no Brasil. Como recorte temporal, adota a promulgação da Constituição Federal de 1988 no Brasil para defender a tese de que o problema central da efetividade do direito à saúde em solo brasileiro resulta do fato de que o Direito sofre influência externas sem preservar sua autonomia, fato diverso do que sucede no Canadá
