Dans la nomenclature des nouveaux objets du droit constitutionnel figure en bonne place la question de la performance. Cette évolution est consécutive au fait que ledit droit ne se contente plus d’encadrer le pouvoir et d’énoncer les droits et libertés. Il s’intéresse désormais à la bonne gouvernance et aux résultats de l’action publique. Seulement, l’exaltation de la performance ne s’opère pas avec la même ampleur dans tous les espaces. Dans le nouveau constitutionnalisme des États d’Afrique noire francophone, c’est de manière timide que celle-ci est prise en compte, ce qui constitue un paradoxe au regard de la crise de gouvernance ambiante sur l’ensemble du continent africain. À l’analyse des lois fondamentales et de la dynamique constitutionnelle, il se dégage le double constat de l’aménagement lacunaire et de l’évaluation déficitaire de la performance dans les États à l’étude.
