Abstract
L’efficacité et l’effectivité de la règle de droit requièrent sa conformité avec les agirs quotidiens de ses destinataires. L’Organisation pour l’harmonisation en Afrique du droit des affaires (OHADA), via la commercialité qu’elle postule, ne devrait pas perdre de vue cette exigence si elle aspire réellement au développement par l’intérieur. Repenser la commercialité s’inscrit dans cette perspective d’appropriation du droit OHADA par son ancrage dans les réalités socioéconomiques.
