Traditionnellement, le concept de droit global s’appréhende comme un droit sans frontière échappant aux États sous l’impulsion d’accords internationaux et de la mondialisation des échanges économiques. L’étude comparative du droit des marchés publics en France et au Québec permet ainsi de questionner le concept de droit global. Si des convergences juridiques s’observent naturellement en raison des accords internationaux concernant la passation des marchés publics, la thèse relève qu’une proportion importante de l’harmonisation juridique dépasse la réception de normes internationales. Des similitudes s’observent dans les normes nationales sans qu’aucune norme supranationale ne l’exige, à l’image du régime des modifications contractuelles. Partant, la thèse propose un autre regard sur le concept de droit global. Celui-ci est présenté comme un système juridique non-autonome résultant de l’intersection (au sens mathématique du terme) de plusieurs systèmes juridiques regroupant des normes juridiques similaires et obéissant à une cohérence narrative portée par les doctrines économiques libérales. L’originalité de la position défendue tient en ce que le droit global n’est plus extérieur à l’État, mais trouve plutôt son essence dans les droits nationaux. Dès lors, le concept de droit global peut trouver une utilité pratique en devenant une matrice normative communes à plusieurs systèmes juridiques. En mobilisant le droit global des marchés publics, le juriste peut ainsi trouver au Québec des solutions aux problèmes juridiques qu’il rencontre en France (et réciproquement) en suivant la réflexion venue de l’extérieur pour la reproduire, avec ses propres normes internes, dans son système juridique.
