Abstract
2022년 12월 19일 생물다양성협약 제15차 당사국총회는 ‘쿤밍-몬트리올 GBF’를 채택하였다. 이는 국가와 지방자치단체는 물론 모든 사회 구성원의 참여를 통해 생물다양성 손실을 중단하고 역전시켜 생물다양성협약의 세 가지 목적을 균형적으로 충실하게 이행하는 것을 목적으로 하는 전지구적 전략계획이다. GBF는 2050년까지 최종적ㆍ이상적으로 달성하고자 하는 상태에 대한 장기적인 목표와 2030년까지 긴급한 조치를 위한 행동지향적 목표 등으로 구성되는데, 실천목표 3에서는 육지 및 해양 면적의 각각 30%를 보호지역으로 지정하여 효과적으로 보전ㆍ관리되도록 보장하는 ‘30×30’ 목표를 제시하고 있다. 비록 당사국총회의 결정이라는 법적 형식을 갖추고 있어 원칙적으로는 법적 구속력이 부재하지만, 생물다양성협약상 당사국 의무를 구체화하고 그 이행 여부는 국제사회로부터 점검되어 사실상 따르지 아니할 수 없다는 점에서 그 결정의 내용을 국내법적으로 이행할 것이 요구된다. 우리나라는 2012년 「생물다양성의 보전 및 이용에 관한 법률」을 제정하여 생물다양성협약에 따른 당사국의 의무를 이행하기 위한 법적 기초를 마련하였다. 하지만 보호지역의 지정ㆍ관리에 관한 근거는 여전히 개별법으로 분산되어 있어 보호지역이 중복으로 지정ㆍ관리되고 그 지정목적이 제대로 달성되지 못하는 경우도 적지 아니하다.따라서 이 글에서는 보호지역의 효과적인 보전ㆍ관리를 달성하기 위하여 생물다양성법의 개선방안을 제시하는 것을 목적으로 한다. 구체적인 방안으로는 ①국제 표준에 부합하는 보호지역의 법적 개념과 유형화 기준의 마련, ②국가생물다양성위원회의 법적 위상과 기능 강화, ③국가생물다양성전략과 그 시행계획 및 개별법에 따른 계획간의 상호연계를 위한 법적 장치 마련, ④지역생물다양성전략의 법정계획화를 통한지역 차원에서의 이행력 제고 등을 제시하였다.
