Abstract
تراجنسیها به خاطر اختلال هویت جنسی که دارند، رفتاری ناسازگار با جنسیت زمان تولد خود ابراز میکنند. همین وضعیت آنها را به عنوان یکی از گروههای آسیبپذیر در برابر جرایم ناشی از نفرت تبدیل نموده است. اهمیت بالای پیشگیری از خشونت و نفرت علیه تراجنسیها به خاطر هویت و ابراز جنسیتی آنها باعث شده است تا شورای حقوق بشر سازمان ملل متحد در سال 2016، قطعنامهای به منظور مقابله و پیشگیری از جرایم ناشی از نفرت علیه آنها وضع نماید. در سطح ملی، نظام حقوقی ایران و کانادا هر دو تراجنسیها را به عنوان افراد با هویت جنسیتی متفاوت به رسمیت شناخته شدهاند؛ با این وجود، در نظام حقوقی ایران به جز برخی از تدابیر پیشگیرنه موردی و پراکنده، تدابیر ساختارمندی دنبال نشده است. در سوی دبگر، نظام حقوقی کانادا در حوزه پیشگیری به ویژه ارتقا سطح آگاهی همگانی، ایجاد فضاها و پناهگاههای امن، تأسیس نیروی ویژه پلیس جرایم ناشی از نفرت و ارائه خدمات تخصصی حمایت از بزهدیدگان، گامهای مناسبی برداشته است. علاوه بر این، جرمانگاری برخی از مصادیق جرایم ناشی از نفرت و تشدید مجازات مرتکبان به تقویت بازدارندگی کمک نموده است. در اینجا پرسش اصلی آن است که مؤلفههای یک نظام پیشگیرانه مؤثر پیرامون بزهکاری مذکور چیست؟ در پاسخ به عنوان فرضیه گفتنی است، تمرکز بر سطوح سهگانه پیشگیری همراه با واکنش کیفری افتراقی راهبردی مؤثر ارزیابی میشود؛ با این مراتب، جستار حاضر با مطالعه تطبیقیِ نظامهای پیشگیری ایران و کانادا، به ترسیم چهارچوبی برای نظامی پیشگیرانه و مؤثر در برابر جرایم یادشده میپردازد.
