Abstract
Article 19 of the Montreal Convention 1999 establishes airline liability for delays causing passenger or baggage damage unless caused by unavoidable circumstances, balancing passenger rights and carrier accountability. This study examines liability for delays stemming from pilot actions, exemplified by United Airlines Flight UA 198’s diversion to San Francisco due to a pilot forgetting to bring his passport onboard, stranding passengers for six hours. A normative legal methodology forms the basis of this study. The analysis draws upon data obtained from primary and secondary sources through the application of statutory and conceptual approaches. The analysis confirms that airlines bear responsibility for the pilot’s conduct under Article 19 of the Montreal Convention 1999, as pilots’ operational control falls within carriers’ domain. Such a situation reflects the Convention's broader intention to ensure that airlines maintain full oversight over their personnel and operational obligations.
