No entendimento do Fisco, a CDA seria título executivo passível de protesto, considerando que tal ato objetivaria tão somente comprovar a inadimplência e o descumprimento da obrigação tributária pelo devedor.A única razão para a adoção do protesto pelo Fisco é o incremento da arrecadação, por meio do constrangimento ao pagamento do crédi to tributário devido, o que desviaria, portanto, a própria finalidade do instituto.Com efeito, estaríamos diante de um perigoso e unilateral ins trumento de coerção a ser adotado pelo Estado para satisfação de seus créditos, sejam aqueles realmente devidos ou até mesmo indevidos.Para incrementar a discussão, é digno de nota que, nos últimos dias do ano de 2012, mais precisamente no dia 28/12/2012, foi publicada a Lei n. 12.767, que versa, principalmente, sobre a extinção das concessões de serviço público de energia elétrica e a prestação temporária do serviço e sobre a intervenção para adequação do serviço público de energia elétri ca.Outrossim, foram realizadas diversas alterações, em outros diplomas legislativos.Entre essas alterações, o art. 25 da nova lei incluiu o parágrafo único ao art.I o da Lei n. 9.492/1997, autorizando expressamente que os entes públicos levem a protesto as certidões de dívida ativa por eles expedidas.
