Abstract
La réforme législative amenée par la Loi sur les renseignements de santé et de services sociaux (Loi 5) déploie une architecture délicate en cherchant à concilier deux impératifs souvent perçus comme contradictoires : la protection de la vie privée et l’accessibilité des données de santé. Tout en érigeant le consentement en principe cardinal, la Loi 5 prévoit des aménagements encadrés pour faciliter l’utilisation secondaire des données à des fins de recherche. Malgré ces ouvertures, le régime de protection des données de santé demeure perçu comme contraignant, ce qui encourage l’exploration de voies alternatives, au premier rang desquelles figurent les données synthétiques. Générées à partir de données réelles sans en constituer des copies exactes, elles appellent à un examen quant à leur capacité à offrir une piste de solution plus opérante pour la conciliation des intérêts privés et collectifs en jeu.
