Abstract
Au Canada, plus de six millions de travailleuses et travailleurs agissent à titre de personne proche aidante parallèlement à leurs responsabilités professionnelles (Gouvernement du Canada, 2016). Les défis qui en découlent amènent certaines personnes à quitter leur emploi ou le marché du travail, faute d’accommodement. Cette recherche vise à identifier les lois qui encadrent et protègent le lien d’emploi des personnes proches aidantes au Canada. Un examen de sources documentaires a permis d’identifier la jurisprudence propre à la conciliation entre la proche aidance et l’emploi. L’analyse montre que les protections ne sont pas uniformes partout au pays. Les gestionnaires peuvent aller au-delà de leurs obligations légales, en offrant volontairement des mesures de conciliation pour répondre plus efficacement aux besoins de la main-d’oeuvre.
