Abstract

Alors qu’un large consensus doctrinal et jurisprudentiel semble se former pour refuser aux oeuvres générées par l’intelligence artificielle le bénéfice de la protection par le droit d’auteur, il devient nécessaire d’en réinterroger les fondements. Car derrière ce refus se joue bien plus qu’un simple débat : c’est la rencontre, parfois heurtée, entre un droit façonné pour l’humain et une création qui s’émancipe désormais de lui. Repenser cette relation, c’est reconnaître que le droit d’auteur, pour demeurer vivant, doit savoir dialoguer avec son temps. L’enjeu n’est donc pas seulement de déterminer si l’intelligence artificielle peut « créer », mais de comprendre comment elle transforme notre manière même de concevoir la création. En retraçant les zones de friction entre l’humain et la machine, nous cherchons à éclairer le chemin d’une refonte équilibrée du droit d’auteur, une refonte qui préserve son âme humaniste tout en embrassant les formes nouvelles de la créativité contemporaine. C’est à cette exploration, à la fois juridique et humaine, que se consacre notre réflexion.
