Abstract

Le présent article vise à proposer un test de proportionnalité pour déterminer dans quelles conditions un lancement d’alerte dans l’espace public – au contraire d’une alerte à l’interne ou auprès d’une instance dédiée – ouvre la porte au régime de protection contre les représailles prévues par le droit québécois. À ce titre, une comparaison est proposée avec les lois québécoise et fédérale visant la protection de la confidentialité des sources journalistiques. On réfléchira aux limites de la Loi facilitant la divulgation d’actes répréhensibles à l’égard des organismes publics et, en particulier, aux alertes non protégées, c’est-à-dire aux divulgations d’actes répréhensibles qui pourraient être d’intérêt public, mais qui sont exclus de jure de la loi.
