Abstract
Cet essai analyse les conflits récurrents dans le secteur de la rénovation d’habitations au Québec et les limites des recours judiciaires traditionnels, souvent longs, coûteux et peu satisfaisants pour les parties. S’appuyant sur la théorie des parties prenantes et sur une analyse normative et jurisprudentielle, l’auteure démontre que l’intégration de mécanismes de prévention et de règlement des différends (PRD) directement dans les contrats de rénovation peut améliorer l’accès à la justice. L’étude propose un mécanisme de PRD adapté à la réalité québécoise, visant à réduire les délais et les coûts des litiges, à renforcer l’équité procédurale et à préserver la relation entre consommateurs et entrepreneurs.
