Abstract
Odogovornost zračnog prijevoznika za putnike i njhovu prtljagu danas je osobito značajan aspekt zračnog prava, posebice zbog konstantnog porasta broja putnika u zračnom prijevozu, kako u Europi tako i u ostatku svijeta. Upravo zbog toga je donesena Montrealska konvencija kao odogovor na prethodnu Varšavsku konvenciju koja je od početka izazivala kritike i nezadovoljstva zbog odredbi koje su bile previše usmjerene na korist zračnog prijevoznika negoli putnika. Montrealska konvencija je usmjerena na bolju zaštitu putnika i plaćanje pravednije odštete u slučaju nesreće. Ovaj rad analizira pravni okvir odgovornosti zračnog prijevoznika prema Montrealskoj konvenciji, uključujući odgovornost za smrt i tjelesne ozljede putnika, odgovornost za zakašnjenje i štetu na prtljazi. Analiziraju se i procesni aspekti, poput nadležnosti sudova i rokova za podnošenje tužbe. Cilj ovog rada je ukazati na značajnu važnost koju Montrealska konvencija ima u zaštiti prava putnika, ali isto tako i prijevoznika.
