Abstract
Prosječan čovjek provede barem polovinu svog života radeći. Posao je ono čemu stremimo i za što se školujemo dugi niz godina. No, ni zavidno obrazovanje i trud nisu nam uvijek garancija da ćemo biti zadovoljni poslom i radnim uvjetima. Često osnovne stvari vezane uz radno mjesto nisu zadovoljavajuće, pa se počinjemo buniti protiv malih plaća, predugog radnog vremena, prekratkih godišnjih odmora i sl. Poslodavci ponekad nemaju sluha za probleme s kojima se radnici susreću, te je štrajk jedino što preostaje nakon iscrpljivanja drugih, manje rigoroznih načina ostvarivanja radničkih interesa. Ovu temu odabrala sam za svoj diplomski rad jer je uvijek aktualna u našim medijima, našem gradu, često i bližoj okolini, te bih ju kao buduća pravnica htjela kroz ovaj rad podrobnije analizirati. Prvo ću objasniti sam pojam štrajka i pravne izvore kojima je štrajk reguliran. Zatim ću kroz kratak povijesni pregled prikazati važnije događaje koji su obilježili povijest štrajka. Dotaknut ću se slučajeva iz prakse Europskog suda za ljudska prava glede povrede odredbe članka 11. Konvencije za zaštitu ljudskih prava i temeljnih sloboda kojom se jamči "Sloboda okupljanja i udruživanja". Nakon toga obraditi ću vrste štrajka, te pravne pretpostavke organiziranja i provođenja štrajka u Republici Hrvatskoj uz primjere iz sudske prakse Vrhovnog suda. Obraditi ću i štrajk u svjetlu prakse Ustavnog suda, te zatim Suda Europske unije ( u daljnjem tekstu: Sud EU) kroz dva najznačajnija slučaja, poznata kao Laval i Viking.
