Abstract
Konvencija o ujednačavanju određenih pravila u međunarodnom zračnom prijevozu iz 1999. godine, poznatija pod nazivom Montrealska konvencija temeljni je akt koji se primjenjuje na cjelokupan međunarodni prijevoz osoba, prtljage ili putnika obavljen zrakoplovom za naknadu ili bez nje, a kojeg obavlja zračni prijevoznik. Članak 17. Montrealske konvencije uređuje odgovornost prijevoznika za pretrpljenu štetu u slučaju smrti ili tjelesne povrede putnika ukoliko se nesreća koja je prouzročila smrt ili ozljedu dogodila u zrakoplovu ili u tijeku bilo koje radnje ukrcaja ili iskrcaja. Prilikom utvrđivanja odgovornosti prijevoznika, u sudskoj praksi javila su se različita tumačenja članka 17. vezano uz sljedeća pitanja: 1) Što se smatra "nesrećom"? 2) Koje su granice tjelesne ozljede, odnosno odgovara li prijevoznik za psihičke bolesti? 3) Što se sve smatra radnjama ukrcavanja i iskrcavanja? Različitim tumačenjem sudova dolazi do neujednačenosti i pravne nesigurnosti umjesto do unifikacije međunarodnog zračnog prava.
