Abstract
The surge in children migrating alone due to violence or persecution has highlighted the need for effective protective measures. Despite international frameworks such as the Convention on the Rights of the Child (CRC) emphasizing the best interests of the child (BIOC), significant gaps remain in the application of these principles. This thesis investigates the complexities of family reunification for unaccompanied minors in the context of international migration. With a focus on Canada and the European Union, doctrinal and comparative methodologies will explore how both regions address the rights and protection of unaccompanied minors. The study seeks to bridge the gap between immigration control and child protection by examining how the CRC's BIOC influences family reunification policies - Canada's restrictive approach to family reunification contrasts with the EU, revealing inconsistencies and challenges. aiming to enhance understanding and inform more compassionate and effective policy reforms.
