Abstract
Para tener claridad sobre los procedimientos establecidos legalmente en la contratación con entidades del estado, debemos conocer la relación de los aspectos, conceptos e individuos que intervienen en la celebración de un contrato estatal. Teniendo en cuenta que un contrato estatal, es un acuerdo entre dos o más individuos, el cual crea obligaciones y responsabilidades entre las partes previstas en las normas de autoridad pública, con el fin de solventar una necesidad social, fomentar el desarrollo, garantizar efectividad en los fines esenciales del Estado consagrados en la constitución política (Artículo 2,Colombia y Título III Artículo del 58 al 65, Perú), brindar participación toma de decisiones que afectan a la sociedad y asegurar una convivencia pacífica y de orden justo.
