This paper examines the extent to which Copyright Law strikes a balance between private rights of ownership and freedom of expression. My approach draws upon examples from Canada and Australia, jurisdictions in which the region between copyright and freedom of expression is relatively uncharted territory. Part I briefly examines the underlying rationales of both freedom of expression and copyright. Part II analyses the efficacy of mechanisms within copyright law designed to facilitate a balance between private ownership and free expression. Part III examines factors external to copyright law itself, affecting the balance between private and public rights, and therefore affecting freedom of expression. Part IV concludes the argument and contemplates divergent alternatives for redressing copyright law and whether in practice such changes would affect the existing balance between private rights of authorship and public rights to access and use of information.
