Abstract
The absolute sovereignty of the Crown, premised on the introduction of the Doctrine of Discovery as a legal concept, continues to inform judicial decision-making in Canada at the highest level. A lack of clarity as to the appropriate standard of review, coupled with deference to both administrative decision-making and to the Crown’s executive function, have resulted in significant uncertainly with respect to the interpretation of s.35 rights, the scope of the Crown’s duties, and the nature of the relationship between Indigenous nations and the Crown. This uncertainty has been compounded by the frequent judicial mischaracterization of s.35 rights as Charter - analogous rights, subject to reasonable limits based on external considerations. There is therefore an urgent need for a fresh approach s.35 - a post-modern era of Indigenous rights litigation - grounded in inherent Indigenous territorial sovereignty and recognition of the constitutional partnership between the Crown and Indigenous nations.
