Abstract
L’objet de la thèse de doctorat est le phénomène du partenariat public-privé, contrat entre, d’une part, une autorité publique, l’Etat, et d’autre part une entreprise, un opérateur économique. Le point de départ de la thèse de doctorat a été la littérature en matière d'administration publique, de gestion publique et d'économie. L'une des conclusions qui en ressort est que la confiance entre le partenaire public et le partenaire privé joue un rôle important dans la réussite d'une telle coopération, outre l'élaboration d'un contrat solide. La question de posait ensuite alors demandé comment cela pouvait se traduire sur le plan juridique. La thèse d'abord examiné comment cette donnée pouvait s'inscrire dans l'évolution du rôle des autorités publiques et dans le droit des systèmes juridiques étudiés. La thèse a ensuite cherché à voir si cela pouvait se traduire en principes applicables à la conclusion et à l'exécution de tels contrats. Six systèmes juridiques ont été étudiés : la Belgique, les Pays-Bas, la France, l'Angleterre, l'Australie et le Canada, en tenant parfois compte du droit de l’Union européenne.
