Abstract
The Crown’s assertion of sovereignty in Canada hosts significant internal inconsistencies, primarily the ex post facto application of the doctrine of discovery in the nineteenth century in Canada. As a result of the Crown’s assertion of sovereignty, and after decades of development lasting over a century, Canadian courts devised the doctrine of Aboriginal title, a property law doctrine whereby Indigenous peoples can obtain a sui generis interest in land. Considering an alternative narrative of sovereignty, wherein both the Crown and Indigenous peoples are sovereign self-determined nations within Canada, a doctrine to replace Aboriginal title is necessary. Inspired from allodial title and concerned with identifying Indigenous homelands rather than boundaries of a property right, a new doctrine is proposed: Indigenous allodial homeland. Indigenous allodial homeland promotes Indigenous sovereign self-determination’s flourishing and provides a territorial foundation for Indigenous peoples to interact with the Crown’s sovereign self-determination in a constellation of interrelationship.
