Abstract
El presente trabajo para optar al título de abogado, es el resultado de la práctica jurídico empresarial desarrollada en Electrificadora de Santander S.A. E.S.P., cuyo objetivo principal fue apoyar la gestión judicial en el cobro de cartera morosa generada con ocasión del no pago de la factura de servicios públicos domiciliarios por parte de los usuarios y/o suscriptores del servicio público de energía eléctrica. En primer lugar, se hará referencia a los antecedentes normativos del proceso ejecutivo en Colombia y de la regulación de los servicios públicos domiciliarios a partir de la expedición de la Constitución Política de 1991. Posteriormente, se abordará de manera general el contenido del Régimen de Servicios Públicos Domiciliarios en Colombia (Ley 142 de 1994), haciendo énfasis en la norma que establece los elementos que debe contener la factura de servicios públicos para prestar mérito ejecutivo y, en consecuencia, faculta a la empresa prestadora del servicio su cobro mediante la jurisdicción ordinaria. Asimismo, se explicarán las diferentes etapas que debe surtir el proceso ejecutivo, de conformidad con las disposiciones contenidas en el Código General del Proceso (Ley 1564 de 2012). Finalmente, se describirá cada una de las actividades y diligencias realizadas por el practicante en el marco de las funciones de vigilancia y sustanciación de los procesos jurídicos adelantados por Electrificadora de Santander S.A. E.S.P.
