The Concept of Neonaticide in Russian Criminal Law and International Legal Systems

Abstract
At the present stage, the phenomenon of “neonaticide” is not given due attention in the doctrine of criminal law. The study of this institution is mainly reduced to criticism of Article 106 of the Criminal Code of the Russian Federation, when a mother commits murder of her newborn child. Difficulties arise in the application of the criminal law, incorrect qualification of the crime. The authors summarize the points of view, conduct a comparative legal analysis of the development of the institution of neonaticide, both in foreign countries and in Russia, express their opinion on this concept and proposals for improving criminal law norms
