Abstract
本研究では, 新たな自由刑制度の在り方のうち, 1)少年受刑者に対する自由刑制度の在り方と, 2)自由刑の全部執行猶予の一部取消制度の可能性に焦点を当てて検討を行った。 1)少年受刑者に対しては全国に少年刑務所が6施設設置されていて, 20歳未満の受刑者と, 20歳を超過した場合でも, 入所から3年間は少年受刑者としての特別な処遇を行っているとされる。特に, 代表的な少年刑務所とされる川越少年刑務所では, 教科指導や生活指導に力を入れ, 作業にしても園芸作業や職業訓練を行っている。しかし, 本調査で訪問調査を行った姫路少年刑務所と函館少年刑務所では, 一般の成人受刑者同様, 生産作業などの刑務作業の比率が高いことが明らかになった。しかし, 少年受刑者については, その問題性に応じた改善指導や職業訓練の比重を高める必要がある。また, その前提として, 現行刑法には身柄拘束中に作業を刑罰として科す懲役制度があるが, 韓国では, 懲役と禁錮を一本化し, 必要な場合, 矯正処遇を行うとして, 作業を刑罰として義務付ける制度を廃止する方針としており, 少年受刑者に限らず, 矯正処遇の充実を図るうえで我が国の制度も同様とすべきである。 2)全部執行猶予中の再犯や遵守事項違反があり全部執行猶予が取り消される場合は, 全部執行猶予の全てが取り消されるため, 全部実刑となる。しかし, それでは, 仮釈放が認められないと, 社会内処遇の機会がないため, カナダの条件付刑(conditional sentence)のように, 取り消す場合でも, 猶予刑の一部に限って取消し, 刑事施設での収容後, 釈放する時点で, 猶予刑が残っているようにすることで, 刑の一部執行猶予同様, 施設内処遇と社会内処遇の有機的連携を図ることができる。 In this research, reform of imprisonment system as a punishment was examined with a special focus on 1) imprisonment against juvenile inmates and 2) partial revoke of totally suspended execution of imprisonment. 1) A special treatment is conducted for juvenile inmates as well as young adult inmates for three years after admission in 6 juvenile prisons in Japan. Especially, academic education and life guidance are emphasized and job training and horticulture are provided as prison work in Kawagoe Juvenile Prison as a representative juvenile prison. However, according to the Author' research, general production work constitutes large portion of treatment in other three juvenile prisons. Accordingly, treatment program and job training should be enhanced according to the criminality of juvenile inmates. As the premise, imprisonment with and without labor should be unified as a single imprisonment system such as in Korea, where new draft of Penal Code provides that correctional treatment shall be provided, if necessary, to inmate of imprisonment. 2) Totally suspended execution of imprisonment shall or can be revoked if the convicts commit re-offending or violates the condition. As a result, the convict is required to serve all of the imprisonment term and might be released without community supervision, which is at high risk of re-offending without any supervision or guidance. Therefore, partial revoke of totally suspended execution of imprisonment should be granted, which make the convict be subject to community supervision after serving a part of imprisonment term, such as conditional sentence system of Canada.
