Bien que la personne incarcérée soit dépourvue de sa liberté d’aller et venir, il n’en reste pas moins que son droit à la santé est reconnu, garanti et protégé en vertu du droit à la santé à l’article 12-1 du Pacte international relatif aux droits économiques, sociaux et culturels. Toutefois, sa mise en œuvre est freinée par la pratique pénitentiaire la rendant ineffective. Celle-ci comprend entre autres l’ordre, la sécurité, les conditions inhérentes liées à la détention, mais également les difficultés structurelles (par exemple : la vétusté des locaux, la promiscuité). En raison de cette pratique, il existe une inadéquation des services et des soins de santé en détention. Cette thèse démontre l’ineffectivité du droit à la santé de la personne incarcérée en France et au Canada. Nous démontrons que cette ineffectivité est présente en raison du conflit entre le concept de la santé et la pratique pénitentiaire. En effet, ce conflit engendre un écart entre le droit à la santé et son degré de réalisation ne permettant pas à la personne incarcérée de jouir du meilleur état de santé qu’il lui soit possible d’atteindre. En outre, l’ineffectivité du droit à la santé de la personne incarcérée se pose par l’incompatibilité du concept de santé au milieu carcéral. Cette thèse propose une nouvelle approche de l’effectivité du droit à la santé de la personne incarcérée. Cette approche prend en considération les réalités pénitentiaires et jongle entre les différents freins au droit à la santé en milieu carcéral.
