Abstract
28 października Komisja Europejska w odpowiedzi na wniosek niemieckiego regulatora ogłosiła decyzję określającą warunki większego wykorzystania przepustowości lądowej odnogi Nord Stream – gazociągu OPAL – przez rosyjski koncern gazowy Gazprom (i ewentualnie inne firmy). Decyzja ta rodzi szereg pytań ze względu na treść, tryb, kontekst jej wydania oraz możliwe konsekwencje. Wątpliwości potęguje nieprzejrzystość informacji dotyczących zarówno samego gazociągu OPAL i pierwotnych zasad jego wykorzystania (w tym wyłączenia z zasady dostępu strony trzeciej – TPA), jak i obecnej decyzji KE. W rezultacie decyzja Komisji rodzi sprzeczne reakcje. Z jednej strony widziana jest (m.in. przez stronę polską czy ukraińską) jako ułatwiająca Gazpromowi większy dostęp do rynku europejskiego kosztem bezpieczeństwa dostaw do Europy Środkowej i tranzytu przez Ukrainę, z drugiej zaś – jako niespełniająca oczekiwań Gazpromu i operatora OPAL, szukających większych możliwości długoterminowego rezerwowania przepustowości gazociągu. Nie jest więc pewne, kiedy oraz czy w ogóle warunki wykorzystania OPAL w zaproponowanym przez KE kształcie zostaną wdrożone, a w konsekwencji – czy podjęta decyzja zakończy wieloletni proces negocjacji zasad wykorzystania niemieckiego gazociągu.
