Abstract
On the basis of Russian court decisions rendered in 2014 the authors analyze Russian judicial practice regarding the two most important issues relating to the negative effect of an arbitration agreement: assessment of the validity and enforceability of an arbitration agreement by a state court when deciding on the issue of whether a statement of claim should be left without consideration and determination of the moment before which a party relying on an arbitration agreement may request a court to leave a statement of claim without consideration.
