Abstract
Cet article examine le rôle du juge africain dans la protection des déplacés internes face aux catastrophes climatiques, dans un contexte d’urgence croissante en Afrique subsaharienne. Il identifie le droit à un environnement sain, consacré par la Charte africaine et plusieurs constitutions nationales, comme un outil juridique stratégique pour garantir les droits fondamentaux des personnes déplacées à l’intérieur de leur pays (PDI). L’analyse met en évidence les tensions entre les délais judiciaires et l’impératif d’une réponse rapide, ainsi que les limites des cadres institutionnels existants. L’article plaide pour une interprétation évolutive du droit et une mobilisation renforcée des juges, en s’appuyant sur des précédents jurisprudentiels. Enfin, il préconise des réformes structurelles, une meilleure coopération régionale et l’intégration du droit climatique dans les politiques publiques, soulignant la nécessité d’une réponse coordonnée face aux déplacements climatiques.
