Problem reprezentacji społecznej w kanadyjskiej ławie przysięgłych do spraw karnych Rozważania wstępne Ze wszystkich instytucji, które byłe dominia brytyjskie recypowały do swoich sys temów prawnych, a które wciąż współcześnie stanowią jedną z najbardziej cha rakterystycznych cech systemu common law, najpowszechniejszą jest niewątpliwie ława przysięgłych (jury).Spośród krajów będących pod wpływem brytyjskiego sys temu prawa jedynie Indie i Republika Południowej Afryki zupełnie zrezygnowały z ławy przysięgłych, natomiast pozostałe państwa tego obszaru prawnego nie tylko korzystają z procesów z udziałem sędziów przysięgłych, ale traktują je jako funda mentalną gwarancję sprawiedliwego procesu sądowego1.Są wśród nich państwa, w których na przestrzeni kilkudziesięciu lat doszło do ewolucji ławy przysięgłych: z instytucji o charakterze stricte prawnym do instytucji politycznej, mającej zna czący wpływ na funkcjonowanie wymiaru sprawiedliwości ico za tym idziena kontrolowanie władzy państwowej przed bezpodstawnym naruszaniem praw pro cesowych jednostek2.W tym wymiarze wydaje się, że jury stanowi współcześnie jedną z podstawowych instytucji mających jednoczesny wpływ na kierunek rozwo ju prawa i na podniesienie stopnia demokratyzacji państwa. 1 Na temat funkcjonowania ławy przysięgłych w różnych państwach systemu common law zob.N.
