Malgré ses exceptionnels potentiels en termes de ressources naturelles , Madagascar reste parmi les pays les plus pauvres au monde . Pourtant, le domaine public peut devenir une source de revenus grâce à sa valorisation économique et constitue un moyen pour soutenir le développement du pays à travers une gestion efficace et rationnelle. La multiplication des atteintes sur le domaine public et la nécessité de moderniser sa gestion tournée vers la culture de performance et de rentabilité ont conduit à la réflexion sur la réforme du régime de la domanialité publique malgache axée sur les potentiels naturels du pays. Réputée comme étant transversale, la réforme du régime de la domanialité conduit à la réforme d'autres disciplines dans un souci de cohérence et d'effectivité des normes juridiques. La conservation de l'originalité du droit malgache nécessite la mise en œuvre des valeurs traditionnelles, depuis la publication des textes par le biais du « kabary » jusqu'à la répression des infractions relatives aux contraventions au domaine public à travers les « Dina ». Consécutivement à cette réforme, le renforcement et le développement de compétences de la juridiction administrative malgache participent également à la promotion de cette juridiction qui est encore moins connue des citoyens.
