La laïcité est une valeur fondatrice et un principe essentiel de la République française. Ce principe évolutif s'incarne dans de nombreuses obligations juridiques qui sont réparties dans de nombreux textes, ce qui peut expliquer les débats qu'il ne cesse de provoquer notamment dans le milieu professionnel.Cette étude va s'attacher à mettre en évidence la laïcité dans le domaine du droit du travail où le fait religieux prend une place de plus en plus importante. Les institutions représentatives du personnel deviennent les témoins du conflit entre le droit et le spirituel au travail et apparaissent démunies quant aux solutions à apporter. L'apport de la loi Travail n° 2016-1088 du 8 août 2016, donnant la possibilité d'insérer une clause de neutralité dans les règlements intérieurs des entreprises privées, n'a pas eu l'effet escompté. La solution peut se trouver dans l'instauration d'un régime juridique proche de celui pratiqué au Canada ou en Angleterre ou par le développement en France du télétravail et de l'entreprenariat permettant une liberté religieuse totale des salariés. Il est également important de modifier et de moderniser le principe de laïcité afin qu'il évolue avec la société.
