Abstract
Les violences sexuelles sont un intemporel des conflits armés. Existantes et tolérées dès l’Antiquité, elles ont progressivement été prohibées et condamnées, d’abord au niveau national, puis sur la scène internationale à compter de la Seconde Guerre mondiale. Contemporainement, elles sont reconnues comme des violations graves du droit international humanitaire et des droits humains, et gagnent une place majeure dans les poursuites pénales internationales, mais également dans l’agenda politique onusien et régional. Toutefois, des zones d’ombre demeurent, et certaines catégories de victimes ou dimensions infractionnelles font l’objet de débats juridiques, doctrinaux ou d’un traitement différencié en fonction des institutions auxquels ils sont confrontés. Cette étude analyse le cadre légal entourant ces infractions, étudiant les évolutions des qualifications, leurs composantes, leurs influences et leurs limites. Un système n’existant sans ses acteurs, ce travail de recherche se consacre également à l’étude des victimes, des accusés et des membres de tribunaux pénaux internationaux et hybrides, pour appréhender leur vécu des institutions judiciaires internationales et leur traitement par celles-ci. Cette thèse plaide pour un renforcement des mécanismes internationaux et nationaux de répression, une meilleure prise en compte des besoins des victimes et une approche holistique qui allie justice rétributive, réparatrice, transitionnelle et prévention des violences sexuelles en temps de conflit armé.
