Abstract
Depuis le début du XXIe, plusieurs grandes démocraties réputées stables et abouties connaissent des phénomènes séparatistes, par lesquels des groupes œuvrent à décentraliser politiquement leurs territoires. Qu’ils aient abandonné les armes ou qu’ils soient nés d’un projet pacifique, ils se distinguent des mouvements séparatistes du XXe siècle par leur institutionnalisation. Au Québec, en Catalogne, en Ecosse, en Flandres, en Corse et ailleurs, ces mouvements se sont installés au pouvoir par des voies légales et démocratiques, remettant en cause la souveraineté des Etats centraux tout en participant à leur vie politique et institutionnelle. L’indépendance, dans ce contexte, ne semble plus nécessairement recherchée. Ce faisant, les séparatismes institutionnalisés la manière dont le droit public appréhende la question de la réunion politique : alors qu’ils ne relèvent plus du droit international et que le droit européen peine à donner du corps à leur revendication, on les voit porter de véritables projets constitutionnels séparatistes, qui stimulent la réflexion sur le droit constitutionnel lui-même.
